14-Day Statutory Right of Withdrawal

Consumers purchasing through constantlyvariedgear.shop will generally have a statutory right to withdraw from an eligible distance contract within 14 days, subject to applicable legal exceptions.

For purchases involving goods, the statutory period generally starts when the consumer, or a third party designated by the consumer other than the carrier, receives the goods.

Where one order contains several goods delivered separately, the applicable statutory rules concerning commencement of the withdrawal period will apply.

A consumer does not need to provide a reason for exercising the statutory right of withdrawal.

The withdrawal must be communicated clearly within the applicable statutory period.

Customers may also use any electronic withdrawal functionality made available on constantlyvariedgear.shop where legally required and available.

Electronic Withdrawal Function

Where German law requires an electronic withdrawal function for a qualifying online distance contract, constantlyvariedgear.shop will make such functionality available through the online interface in accordance with applicable requirements.

Using such functionality is an additional method for exercising the statutory right of withdrawal and does not eliminate other legally permitted methods of communicating a withdrawal.

Voluntary 30-Day Return Period

In addition to applicable statutory rights, constantlyvariedgear.shop provides a voluntary return period of 30 days after delivery for eligible products.

To qualify for a voluntary return after expiry of the statutory withdrawal period, the product should generally:

  • Be returned within 30 days after delivery;
  • Be in substantially the same condition in which it was received;
  • Be unworn or unused other than reasonable inspection;
  • Be clean;
  • Contain original components and accessories;
  • Contain original labels or tags where reasonably possible; and
  • Be packaged appropriately to prevent avoidable damage in transit.

This voluntary return policy does not reduce or replace statutory rights concerning defective or non-conforming goods.

How to Request a Return

A reason is not required when a consumer validly exercises a statutory right of withdrawal.

Return Instructions

Products should not be sent to an unrelated address, carrier office or address found independently online.

After the return request has been reviewed, we will provide the applicable return instructions and, where relevant, the appropriate return destination.

Return Shipping Costs

For a standard voluntary return or statutory withdrawal where the customer has been properly informed that the customer must bear direct return costs, the customer may be responsible for the direct cost of returning the goods.

Where products are returned because they are defective, damaged on arrival, materially not as described or incorrectly supplied, return costs will be handled consistently with applicable statutory rights.

We will not impose return costs in circumstances where applicable law requires us to bear them.

Damaged Products

Customers are encouraged to inspect products reasonably promptly after delivery.

  • The damaged product;

  • The packaging; and
  • Any shipping damage.

Defective Products

Products should conform to the applicable contract and mandatory legal requirements.

Missing Products

We may review shipping records, packaging records, carrier information or other relevant documentation before determining the appropriate solution.

Exchanges

Where operationally possible, an exchange may be offered for an eligible product.

Availability of an exchange depends on inventory.

Where an exchange is unavailable, a refund or another appropriate remedy may be offered.

Statutory rights are not dependent on our ability to provide an exchange.

Refunds Following Statutory Withdrawal

Where a valid statutory withdrawal applies, refunds will be processed in accordance with applicable German law.

This generally includes amounts paid under the contract and, where legally required, the cost of the least expensive standard delivery method offered by the store.

Additional delivery charges resulting from the customer choosing a more expensive delivery option than the least expensive standard method need not necessarily be refunded where applicable law allows.

Because standard shipping at constantlyvariedgear.shop is free, there is normally no standard outbound shipping charge to refund.

Refund Timing

Where statutory withdrawal rules apply, we will process the reimbursement within the period required by applicable law.

For sales of goods, we may be legally entitled to withhold reimbursement until we have received the returned goods or the customer has supplied evidence of having sent the goods back, whichever occurs first, unless applicable law provides otherwise.

For voluntary returns outside the statutory withdrawal period, refunds will normally be processed after the returned product has been received and inspected.

Refund Method

Where required by law, reimbursement will normally be made using the same means of payment used for the original transaction unless another method has been expressly agreed and does not result in additional costs to the customer.

The time taken for a completed refund to appear in a customer's account may depend on the payment provider, bank, card issuer or other financial institution.

Condition of Returned Goods

During the statutory withdrawal period, consumers may inspect goods to the extent reasonably necessary to establish their nature, characteristics and functioning.

Where applicable law permits, a consumer may be responsible for diminished value caused by handling beyond what is reasonably necessary for such inspection, provided the applicable statutory requirements have been satisfied.

Normal lawful inspection does not itself eliminate the right of withdrawal.

Exceptions to Withdrawal

Products Showing Normal Wear

Our voluntary return policy does not ordinarily cover damage caused by:

  • Excessive wear; or
  • Use inconsistent with the product's intended purpose.

Promotional Items

Unless clearly stated otherwise, products purchased during a promotion or sale remain subject to applicable statutory consumer rights.

A promotional price does not remove statutory withdrawal or conformity rights merely because the product was discounted.

Gifts

Where an order was purchased by one person and delivered to another, refunds will normally be processed to the original payment method unless applicable law or the specific circumstances require otherwise.

Returned Packages That Cannot Be Identified

Customers should include sufficient order information when making a return.

Where we receive a package that cannot reasonably be linked to an order, processing may be delayed while we attempt to identify the transaction.

Refused Deliveries

Refusing delivery does not necessarily constitute a legally sufficient withdrawal declaration in every circumstance.
